These Terms and Conditions constitute a legally binding agreement between you and Rising Moon Farm ("DaivaVarna"). By accessing the Platform, you acknowledge that we are a Marketplace Facilitator providing a venue for independent third-party Vendors to list goods and services.

PART 1: TERMS FOR VENDORS (The "Sellers")

1. Independent Entity Status

Vendors are independent contractors and not employees, partners, or agents of the Platform. You acknowledge that the Platform does not manufacture, store, inspect, or deliver any products.

2. Mandatory Category Warranties

• Sattvic Foods & Perishables: Vendors warrant that all food items are prepared, packaged, and shipped in compliance with FDA guidelines and local health department regulations. You assume all liability for foodborne illness, contamination, or spoilage.
• Ayurveda & Medical Products: Vendors must comply with FTC and FDA labeling requirements. You warrant that you possess all necessary professional licenses and that your product descriptions contain no "unapproved new drug" claims (e.g., claiming to treat, cure, or prevent a disease).
• Accommodations (Ashrams, Farm Stays, etc.): Vendors warrant that properties comply with all US Building Codes, ADA requirements, and Fire Safety regulations. You are solely responsible for guest safety.

3. Indemnification

Vendor agrees to indemnify, defend, and hold harmless the Platform from any claims, damages, or legal fees arising from Vendor’s products, services, or professional advice.

PART 2: TERMS FOR USERS (The "Buyers")

1. "As-Is" Service & Waiver of Liability

The Platform is provided on an "As-Is" basis. To the maximum extent permitted by law, the Platform disclaims all warranties, express or implied. You agree that your use of any product or service is at your sole risk.

• Not Medical Advice: All information regarding Ayurvedic Medicine is for educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.
• Assumption of Risk: Users acknowledge that herbal products are not FDA-approved. You must consult a licensed physician before use. The Platform assumes no responsibility for adverse reactions or heavy metal toxicity.

1. Sattvic Foods & Organic Farm Produce

• Perishables Disclaimer: Users assume the risk of shipping perishables. The Platform is not responsible for the hygiene of the Vendor’s kitchen or the condition of food upon arrival.
• Allergens: The Platform does not verify allergen claims. Users with severe allergies use the platform at their own risk.

III. Accommodations & Retreat Centers

• No Inspection: The Platform has not physically inspected any Ashram, Temple Guesthouse, or Residential Stay. Users are responsible for verifying the safety of the premises.
• Travel Risk: The Platform is not responsible for any injury, theft, or dissatisfaction occurring during a stay.

• Entertainment Purposes: All consultations (Vedic, Chinese, etc.) are provided for spiritual guidance or entertainment purposes. The Platform is not liable for any life decisions or financial losses resulting from these readings.

1. Domestic Services & Caregiving

• Background Checks: The Platform does not conduct criminal background checks on service providers. Users are solely responsible for vetting individuals (Caregivers, Tailors, Masseuses) before granting them home access.

These Terms are governed by the laws of the State of North Carolina. Any legal action against the Platform shall be limited to the amount of the commission earned by the Platform on the specific transaction in dispute.
