DAIVAVARNA CUSTOMER MARKETPLACE TERMS

About DaivaVarna

DaivaVarna is a curated multi-vendor marketplace through which Customers may discover and transact with independent Sellers, artisans, farmers, practitioners, teachers, Hosts, Event Organizers, Employers, and Service Providers offering approved traditional, devotional, natural-living, cultural, educational, community-oriented, and related Products and Services. DaivaVarna may facilitate discovery, checkout, payment, messaging, returns, reviews, booking, and Marketplace enforcement, but the identified third-party Vendor ordinarily remains responsible for the underlying Product, Service, property, Event, or employment opportunity.

1. Acceptance and Eligibility

1.1 Acceptance. By creating an account, placing an Order, making a booking, submitting an application, or otherwise using a feature that states these Terms apply, the Customer agrees to these Customer Marketplace Terms and the applicable Marketplace Policies.

1.2 Legal Capacity. A Customer must have legal capacity to enter into the transaction. Features involving minors may require parent or guardian participation or consent under Applicable Law and Marketplace Policy.

2. Customer Accounts

2.1 Accurate Information. The Customer shall provide accurate account, delivery, contact, booking, and payment information and keep material information reasonably current.

2.2 Account Security. The Customer is responsible for reasonable protection of credentials and shall promptly report suspected unauthorized account access or payment misuse.

2.3 No Impersonation. A Customer shall not impersonate another person, create accounts for fraudulent purposes, or use another person’s identity or payment method without authorization.

3. Marketplace Role and Seller Relationship

3.1 Independent Vendors. Unless a Listing expressly states that DaivaVarna itself is the Seller, the purchase or Service relationship is with the identified third-party Vendor.

3.2 Marketplace Functions. DaivaVarna may provide technology, moderation, verification, payments, refund assistance, reviews, messaging, category standards, and enforcement without becoming the manufacturer, Host, Teacher, Practitioner, Employer, Event Organizer, or Service Provider.

3.3 Verification Limits. A DaivaVarna verification badge or category approval means only that the stated type of information was reviewed to the extent described. It is not a guarantee of character, outcome, safety in every circumstance, or continuing legal compliance.

4. Orders and Availability

4.1 Order Conditions. Orders may be subject to Vendor acceptance, inventory, payment authorization, fraud screening, category restrictions, shipping eligibility, destination law, and other applicable conditions.

4.2 Cancellation by Marketplace or Vendor. An Order may be cancelled where fulfillment is impossible, unlawful, unsafe, fraudulent, materially mispriced because of an obvious error, or contrary to Marketplace Policy, subject to Applicable Law and refund obligations.

5. Pricing, Taxes and Mandatory Fees

5.1 Displayed Price. DaivaVarna and Vendors shall provide pricing and mandatory charges as required by Applicable Law. Government charges, shipping, optional additions, and other amounts may be shown separately where legally permitted.

5.2 Accommodations and Live Events. For covered short-term lodging and live-event ticket transactions, mandatory fees known and calculable in advance should be included in the total price presentation where required by Applicable Law.

5.3 Taxes. Taxes, duties, VAT, GST, customs, or other governmental charges may apply depending upon the Customer, Vendor, destination, transaction type, and law.

6. Payments

6.1 Payment Providers. Payments may be processed by authorized third-party payment providers. Their terms, verification, fraud controls, settlement rules, and supported countries or currencies may apply.

6.2 Payment Authorization. For approval-based bookings, a temporary authorization may be placed before final acceptance. If the booking is declined before capture, release timing may depend upon the Customer’s bank or card issuer.

6.3 Direct Payments. Some approved categories may permit the Customer to pay the Vendor directly. DaivaVarna ordinarily cannot directly reverse funds that never passed through DaivaVarna’s authorized payment system.

7. Shipping, Delivery and International Orders

7.1 Shipping Policy. Physical Products are subject to the DaivaVarna Shipping, Delivery, Local Pickup and International Orders Policy.

7.2 Customer Address. The Customer is responsible for providing a reasonably accurate delivery address and cooperating with lawful delivery, customs, import, and carrier requirements.

7.3 International Charges. International purchases may incur customs, duties, taxes, brokerage, currency-conversion, or carrier charges. The responsible party will be disclosed where reasonably possible and required by law.

8. Returns, Refunds and Cancellations

8.1 Applicable Policy. Returns, refunds, booking cancellations, Service cancellations, Event refunds, and digital-content remedies are governed by the DaivaVarna Returns, Refunds and Cancellation Policy and any applicable category terms.

8.2 Problem Products. A change-of-mind restriction does not eliminate appropriate remedies for materially defective, unsafe, counterfeit, wrong, materially damaged, materially misdescribed, or undelivered Products.

9. Services, Practitioners and Traditional Guidance

9.1 Independent Service Providers. Independent Providers remain responsible for the Services they perform, representations they make, and legal professional scope.

9.2 Ayurveda and Health-Related Services. Marketplace information or traditional-health Services are not emergency medical care. Customers should seek appropriate licensed medical assistance for emergencies or conditions requiring regulated healthcare.

9.3 Astrology. Astrology Services may involve interpretive or predictive traditions. DaivaVarna does not guarantee future outcomes, and Customers should not rely on astrology as a substitute for regulated medical, legal, financial, immigration, or other professional advice.

10. Classes and Educational Offerings

10.1 Teacher Responsibility. Teachers remain responsible for course content, delivery, scheduling, qualifications, and accurate statements regarding certificates or accreditation.

10.2 Learning Outcomes. Completion or purchase of a Class does not guarantee mastery, employment, professional licensure, or a particular personal outcome unless a specific legally enforceable promise states otherwise.

11. Accommodations

11.1 Host Responsibility. Hosts are responsible for property safety, cleanliness, lawful operation, amenities, rules, and Listing accuracy.

11.2 House Rules. Customers shall review and comply with lawful house rules disclosed before booking, including vegetarian, devotional, smoking, alcohol, visitor, quiet-hour, or similar rules.

11.3 Platform Role. DaivaVarna does not physically operate an independent Host’s property merely because it lists, books, or processes payment for the stay.

12. Events

12.1 Organizer Responsibility. Event Organizers are responsible for venue, permits, program, safety, capacity, food, security, accessibility, and other Organizer-controlled matters.

12.2 Changes. Minor schedule or program adjustments do not automatically entitle a Customer to a full refund; material cancellations or fundamental changes are governed by the Returns Policy and Applicable Law.

13. Jobs and Employment Opportunities

13.1 Employer Responsibility. Employers remain responsible for job accuracy, hiring, wages, classification, workplace safety, work authorization, discrimination law, payroll, and other employment obligations.

13.2 No Employment Guarantee. DaivaVarna does not guarantee interviews, offers, employment, sponsorship, wages, or the legitimacy of every representation merely because a job is listed, although DaivaVarna may verify Employers and enforce Marketplace rules.

14. Reviews and Customer Content

14.1 Genuine Experience. Reviews should reflect genuine Marketplace experience and must not be fabricated, purchased, or submitted through deceptive identities.

14.2 Prohibited Content. Customer content shall not contain threats, unlawful harassment, doxxing, extortion, intentionally false factual allegations, confidential information, spam, or infringement.

14.3 Negative Reviews. A negative opinion is not prohibited merely because a Vendor disagrees with it. DaivaVarna may moderate content for Policy violations while preserving legitimate Customer feedback.

15. Prohibited Customer Conduct

15.1 Misuse. Customers shall not use DaivaVarna to commit fraud, launder money, acquire prohibited Products, evade sanctions or customs rules, manipulate reviews, harass users, attack Platform systems, scrape the service unlawfully, or infringe third-party rights.

15.2 Refund Abuse. Customers shall not make knowingly false non-delivery claims, return substitute Products, fabricate damage, submit fraudulent evidence, or seek duplicate recovery for the same loss.

16. Privacy and Communications

16.1 Privacy Policy. DaivaVarna’s collection and use of Personal Information is described in the Privacy Policy and Cookie and Similar Technologies Policy.

16.2 Transaction Communications. Customers may receive communications necessary for accounts, Orders, shipping, booking, security, legal notices, refunds, and support. Marketing communications are subject to applicable consent and opt-out rules.

17. Disclaimers and Liability

17.1 Marketplace Availability. DaivaVarna seeks to provide reliable Marketplace functions but does not promise uninterrupted or error-free availability in every country, device, payment method, or circumstance.

17.2 Third-Party Conduct. To the fullest extent permitted by Applicable Law, DaivaVarna is not responsible for independent Vendor conduct or conditions beyond DaivaVarna’s reasonable control, while preserving all non-waivable duties imposed upon DaivaVarna itself.

17.3 Liability Structure. The final liability cap, exclusions, consumer-law savings clause, and dispute provisions shall be completed after the operating entity and governing jurisdiction are fixed and reviewed by counsel.

18. General Legal Terms

18.1 Changes. DaivaVarna may update these Terms prospectively. Material changes will be communicated as required by law.

18.2 Governing Law. Governing law and forum: [FINAL JURISDICTION AND COUNSEL-APPROVED DISPUTE STRUCTURE].

18.3 Severability. If a provision is invalid, the remaining Terms remain effective to the fullest extent permitted by law.
